2 Categories of Personal Data, Purposes and Legal Bases of Data Processing

We process the data that you have sent us in connection with your application, in particular your name, contact details, details of professional qualifications and other details in cover letters, curriculum vitae, certificates, applicant and personnel questionnaires, in order to check your suitability for the position or any other open positions in our company and to carry out the application procedure.

The legal basis for the processing of your personal data within the scope of the application procedure is primarily Sec. 26 Federal Data Protection Act (BDSG). It allows the processing of the data required in connection with the decision to establish an employment relationship. We process other data provided by you in order to safeguard legitimate interests in accordance with Art. 6 (1) (f) GDPR. The legitimate interests are to be better able to assess your suitability for the position in our company.

If we cannot offer you a suitable position at the time of your application, we will store your data in our talent pool so that we can contact you later regarding vacancies. The prerequisite for this is that you have given us your consent. The legal basis is Art. 6 (1) (a) or Art. 9 (2) (b) GDPR. The granting of your consent is voluntary.

Should your data – even after completion of the application procedure – be subject to a legal storage or retention obligations, the legal basis is Art. (1) (c) GDPR. If your data are necessary for the assertion, exercise or defence of legal claims, we will process your data in accordance with Art. 6 (1) (f) GDPR to safeguard the legitimate interests involved therein, even after the application process has been completed.

3 Duration of Storage

If you application was successful, we will keep your data as part of our personnel files.

If we cancel your application, we will delete your data after 6 months at the latest, unless we are obliged to store the data for a longer period due to legal storage or retention obligations or if a longer storage period is required to assert, exercise or defend legal claims.

If you have agreed to your data being stored in our talent pool, we will store the data there for a period of two years. If you have revoked your consent, we will delete the data concerned immediately, unless we are allowed to continue to process your data due to statutory storage or retention obligations or for the assertion, exercise or defence of legal claims, but exclusively for these purposes.

4 Recipients/Categories of Recipients

We process your data only within our company and do not pass them on to third parties without your express consent.

The personnel department will review your applicant data after receipt of your application. If you have sent your application to other positions within our company, the recipient will immediately forward your application to the personnel department. We will make suitable applications internally available to the divisional managers for the respective open position. Within our company, only those persons have access to your data who need it for the proper course of our application procedure.

We process your data exclusively in computer centres that are located within the European Union. A transfer to a third country or an international organisation does not take place.

5 Rights as Data Subject

In accordance with Articles 15 et seq. GDPR, under the conditions defined therein, you have the right to information about the personal data concerning you and to correction or deletion or restriction of processing, a right of objection to processing as well as the right to data portability.

You have the right to complain to a data protection supervisory authority about the processing of personal data by us if you are of the opinion that the processing of the data concerning you violates the GDPR.

If the processing is based on your consent, you also have the right to revoke the consent at any time, without affecting the legality of the processing which took place on the basis of the consent up to the revocation. However, we may need to retain certain data to comply with legal requirements or to pursue legal action (see Section 4).
